Present MCC has been filed seeking restoration of MAC No.1283/2017 whereby the said appeal stood dismissed on account of peremptory order passed by this Court on 14/09/2017. Heard on I.A.No.1, which is an application for condonation of delay in filing the present MCC.

For the reasons assigned in the said application and finding them to be satisfactory, I.A.No.1 is allowed and delay of 175 days in filing the MCC stands condoned subject to the applicant depositing a cost of Rs.5,000/- to the Chhattisgarh High Court Legal Services Authority within a period of 7 days from today. That the applicant on furnishing the certificate of payment of cost, MAC No.1283/2017 shall stand restored to its original number with a further rider that the applicant shall remove default if it has not till date removed within a further period of 2 weeks'.
