Present is a repeat bail application filed under Section 439 of Cr.P.C. in connection with Crime No.80/2017 registered at Police Station City Kotwali, Dhamtari, District Dhamtari (C.G.) for the offence punishable under Sections 384, 385, 424, 406 r/w 34 of IPC.

Present applicant is in jail since 09/03/2017. 3.

The earlier bail application was rejected by this Court on 14/06/2017 vide M.Cr.C.No. 3478/2017.

The counsel for the applicants submits that, subsequent to the rejection of the bail application till date, no evidence on behalf of the prosecution has been examined and the matter was getting delayed on account of confusion

as to which Court has to hear the matter. The counsel for the applicants himself submits that, now the matter has been resolved and is pending before the Court of Chief Judicial Magistrate, Dhamtari. 5.

Looking to the facts and circumstances of the case, particularly, the nature of allegations levelled against the present applicants, this Court is not inclined to grant bail to the applicants at this juncture. 6.

Accordingly, the present bail application stands rejected. 7.

However, it is directed that the trial Court should make all endeavors in concluding the trial at the earliest.
