1. Petitioner claims to be residing in Qr.No.LIG 106 situated at Maharana Pratap Nagar, Korba. He is an employee of the erstwhile Special Area Development Authority (SADA), Korba, which has subsequently merged with the Municipal Corporation, Korba. The erstwhile SADA, Korba, had floated a scheme for allotment of house on rent-cum-purchase basis in
which many number of employees have been benefited and they have purchased the quarters in which they resided. The petitioner has submitted list of such persons as Annexure - P/11. The petitioner alleges that he has moved several representations for extending the facility and benefit of the scheme to him on the conditions set forth by the Corporation, but no action has been taken and in the meanwhile, the quarters in possession of similarly situated employees of the Municipal Corporation, Korba, have been sold to them.
2. Considering the entire facts situation of the case, the writ petition is disposed of with a direction that on petitioner's fresh representation to the respondent No.3 i.e. Commissioner, Municipal Corporation, Korba, for extending benefit of the scheme on similar terms as has been offered to other employees of the Corporation, within a period of one month from today the said respondent No.3 shall decide the petitioner's representation, in accordance with law within a further period of three months.
