Mr. Sudhir Kumar Bajpai, Advocate Hon'ble Shri Justice P. Sam Koshy Order on Board 13/05/2019

1. The challenge in the present writ petition is to the order Annexure P-1 which is the order of dismissal from service dated 26.09.2018.

2. Perusal of the pleadings of the writ petition would show that the petitioner has already preferred a departmental appeal Annexure P-5 to the respondent No. 1 against the order of dismissal. It appears that the appeal is still pending consideration before the respondent No. 1.

3. In view of the fact that departmental appeal of the petitioner is pending before respondent No. 1 this Court is of the opinion that ends of justice would meet if respondent No. 1 is directed to take a decision on the departmental appeal of the petitioner at the earliest preferably within a period of 90 days from today.

4. Reserving the right of the petitioner to challenge the outcome of the departmental appeal, the present writ petition stands disposed off. Sd/- (P. Sam Koshy) Judge Rohit
