The present MCC has been filed seeking restoration of MAC No.1280 of 2017 which got dismissed by way of peremptory order dated 14.09.2017. Learned counsel for the petitioner submits that now he is in position to carry out the amendment and the MCC be allowed and MAC No. 1280 of 2017 be restored to its original number.

For the reasons assigned in the application and considering the facts and circumstances of the case, subject to petitioner's paying an amount of Rs.3000/- as cost before the High Court Legal Services Authority, MAC No.1280 of 2017 stands restored to its original number. On furnishing of receipt of deposit of the costs, MAC No. 1280 of 2017 shall be listed for hearing before the appropriate Bench. It is made clear that defaults which are yet to be cured would also be done within a period of 10 days from today, failing which MCC would again stand dismissed without reference of the Bench.
