With the consent of the learned counsel for the parties, the matter is heard finally.

Learned counsel for the petitioner would submit that the Collector, Rajnandgaon has transferred the petitioner from Chichola, Khairagarh to Aamgaonghat, Chhuikhadan by mentioning that the petitioner has made a request for transfer, however, the petitioner has not made any request nor has applied for his transfer to the transferred place.

In view of the submission made, the matter is required to be considered by the concerned Collector, because if the petitioner has never made any request for transfer, the order may not sustain. 4.

Accordingly, the petitioner is directed to move a representation before the concerned Collector within 4 weeks. The Collector shall consider and decide the representation, at the earliest, preferably within a period of 2 months from the date of submission of representation. 5.

Till the petitioner's representation is decided, the effect and operation of the impugned order shall remain stayed.
