2. The Commissioner Scheduled Caste And Scheduled Tribe Development Mantralaya Indravati Bhavan, Naya Raipur, District Raipur Chhattisgarh. ----Respondents For Petitioner : Shri Paranjal Shukla, Advocate.
For State : Ms. Abhyunnati Singh, P.L.
Hon'ble Shri Justice P. Sam Koshy Order On Board 07.07.2021
1. The limited grievance that the petitioner has in the present writ petition is the non granting of the benefit of time scale pay to the husband of the petitioner on completion of 8 years and 10 years of service and also not granting upgradation of the pay-scale which he was entitled for having put in a particular length of service under the service regulations and circulars governing the field.
2. According to the Counsel for the petitioner, husband of the petitioner was working under the respondents as an Additional Assistant Development Commissioner and who died in harness on 20.01.2013. The contention of the counsel for the petitioner is that upon completion of 8 years and 10 years of service, the husband of the petitioner would
have been entitled for the benefit of time scale pay in terms of circulars governing the field at that point of time which has not been granted to the husband of the petitioner. According to the counsel for the petitioner, the petitioner has repeatedly been approaching the respondents by the representation and reminders which till date has not been considered.
3. Given the said facts and circumstances of the case, the writ petition at this juncture is disposed of directing the respondent No. 2 to immediately scrutise the claim of the petitioner so far as the grant of time scale pay to the husband of the petitioner while he was in service and to take an appropriate decision after due verification of the entitlement part at the earliest preferably within a period of four months from the date of receipt of copy of this order.
4. With the aforesaid observations, Writ Petition stands disposed of. Sd/- 1.
