This is the first bail application under Section 439 of the CrPC and there is no bail application is pending before any other Court. 2.

The applicants have been arrested in connection with Crime No.57/2019 registered in Police Station Mohla, District Rajnandgaon (C.G.) for the offence punishable under Section 34(2) of CG Excise Act. 3.

Argument heard.

Case of the prosecution, in brief is that on 15/04/2019, 40 bulk liters of hand made country liquor has been seized from the possession of the applicant No. 2 Lukesh Kumar. Applicant No. 1 Ram Singh Sinha was accompanied to applicant applicant No. 2 Lukesh Kumar.

Counsel for the State submits that two criminal cases have been registered against the applicant No. 1 Ram Singh Sinha under the Excise Act, however, no antecedent has been reported against the applicant No. 2 Lukesh Kumar. 6.

Looking to the above facts and circumstances of the case, the application is allowed. It is directed that if the applicant No.1 Ram Singh Sinha furnishes two solvent sureties each for a sum of Rs. 25,000/- along with one personal bond of Rs. 50,000/- to the satisfaction of the trial Court concerned with the condition that he will not involve himself in any of the crime in future, he be released on bail. It is further directed that if the applicant No. 2 Lukesh Kumar furnishes one solvent surety for a sum of Rs. 25,000/- along with one

personal bond of Rs. 25,000/- to the satisfaction of the trial Court concerned, he be released on bail.
