2. Director, Public Instruction, Pension Bada Raipur District Raipur (Chhattisgarh).
3. District Education Officer, Dhamtari, District Dhamtari, Chhattisgarh. ---- Respondents 11/01/2017 Shri HB Agrawal, Sr. Advocate along with Shri GP Mathur, Advocate for the petitioner.
Shri PK Bhaduri, Govt. Advocate for the State. The dispute involved in the present case is with regard to correction of date of birth of the petitioner. Learned counsel appearing for the petitioner submits that the respondents have without any basis wrongly entered the date of the birth of the petitioner in the service record due to which he would retire from service before three years of his date of retirement. He further submits that he has filed representations but the same has not been decided till now. Learned counsel for the State submits that two representations referred to in the petition are not made
before the appropriate authority. Therefore, the petitioner may be directed to file a fresh representation before the appropriate authority.
Learned counsel appearing for the petitioner submits that this petition may be disposed of with liberty to the petitioner to file representation afresh before the concerned authority, who in turn, may be directed to decide the same expeditiously.
Accordingly, without entering into the merits of the case, this petition is disposed off. If the petitioner moves fresh representation before the respondent No.2, the respondent No.2 shall take prompt decision on the said representation.
With the aforesaid liberty, the petition stands disposed off.
