Heard on the application filed under Section 439 of the Cr.P.C. This is first bail application before this Court filed by the applicant for grant of regular bail. The applicant has been arrested on 17-02-2019 in connection with Crime No.31/19 registered at P.S. - Rakhi, Raipur, Chhattisgarh for the offence under Section 420, 467, 468, 472/34 of the IPC.

It is submitted on behalf of the applicant that the applicant has been falsely implicated in this case. No case is made out against the applicant. She was simply an employer of Daksh Siksha Foundation and present as invigilator in the said examination which was to be conducted on the date of incident. This applicant has not circulated any advertisement and she is not an office bearer of the said foundation. Therefore, no case is made out against her. Hence, it is prayed that this applicant may be granted bail. 3.

Learned counsel for the State/non-applicant opposes the application. 4.

Heard learned counsel for the parties and perused the case diary. 5.

According to the prosecution case, one Daksh Siksha Foundation

-2circulated the advertisement through WhatsApp and other social media for filling up of vacancies in Agriculture Department, regarding which one entrance exam was held on 17-02-2019. On complaint made by Deputy Director, Agriculture, Harjeet Bhalla police raided the premises of examination where this applicant was found present in possession of some examination material from where she was arrested and detained. Hence, this case. 6.

After considering on the facts and circumstances of this case and considering that the charge sheet has been filed and the case is now pending for trial, I feel inclined to allow this application. 7.

Consequently, this application filed by the applicant under Section 439 of the Cr.P.C. for grant of regular bail is hereby allowed. It is directed that the applicant shall be released on bail on her furnishing a personal bond in the sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned Court, for her appearance as and when directed. 8.
