Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 21/08/2020 This is third bail application. First bail application was rejected on merits and the second bail application was rejected as there was no change in the circumstances.
The third bail application has been moved mainly on the ground of delay in trial. It is submitted that though the allegations are grave, the applicant has remained in jail for a fairly long time i.e. since 04/03/2017 and the trial is not likely to conclude early due to pandemic situation.
Having considered that present is a case of commission of murder, though at present, I am not inclined to grant bail, if trial does not commence within three months from the date of receipt of copy of this order, the applicant would be at liberty to revive bail application.
The application is, accordingly, rejected.
