Learned counsel for the State submits that the case diary shows registration of offence under the provisions of SC/ST (Prevention of atrocities) Act as well.

At this stage the learned counsel for the applicant seeks permission to withdraw this application with liberty to file application for grant of bail before the Court having jurisdiction i.e. the Special Court constituted under SC/ST (Prevention of Atrocities) Act. Therefore, this application is dismissed as withdrawn and liberty is granted as prayed for.
