Applicant has preferred this first bail application under Section 438 Cr.P.C as he is apprehending his arrest in connection with Crime No. 50/2021, registered at Police Station - Kedar, Tahsil - Sarangarh, District Raigarh (C.G.) for the offfence punishable under Sections 34 (2) & 59 (A) of the Excise Act.
3. Learned counsel for the applicant seeks to withdraw this bail application on the ground that the applicant has been arrested, therefore, the bail application has become infructuous.
