1. Petitioner has preferred this writ petition challenging the legality and validity of the various proceedings alleging that there is no proper opportunity granted to the petitioner that he has not encroached upon government land. It is not disputed the petitioner has filed a suit seeking declaration and also praying for permanent injunction.

2. In view of the fact that the civil suit is pending, this Court is not inclined to entertain this writ petition. Accordingly, the writ petition is dismissed with liberty to the petitioner to pursue the civil remedy. Sd/- (Manindra Mohan Shrivastava) Judge Ashu
