This is an application under Section 438 of CrPC for grant of anticipatory bail to the applicant as he apprehends his arrest in connection with Crime No.1 of 2021 registered at Police Station AJAK, District-Raigath, Chhattisgarh for commission of offenses punishable under Sections 420, 120N, 294, 506 of IPC and 3(1)(v), 3(1)(10) of SC and ST (Prevention of Atrocities) Act, 1989 (hereafter referred to as, Act of 1989).

Shri BP Sharma, learned counsel for the applicant seeks permission of this Court for withdrawal of bail application with liberty to file an appeal as provided under Section 14A of Act of 1989.

Shri Roshan Dubey, learned Panel Lawyer and Shri Hari Agrawal, learned counsel for the objector have no objection on the submission of learned counsel for applicant.

As prayed, MCRCA-784 of 2021 is dismissed as withdrawn.

Learned counsel for the applicant submits that the time spent after filing of bail application period may be considered for the purpose of calculating period of limitation. He further submits that a direction may be issued for returning of certified copy of impugned order. 6.
Applicant is at liberty to make appropriate pleadings along with copy of this order for consideration of period of limitation. 7.
Registry is directed to return certified copy of impugned order dated 15.06.2021 to learned counsel for applicant, keeping photocopy of same on record.
