2. These are the three applications filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicants, who have been arrested in connection with Crime No.33/2021 registered at Police Station Suhela, District Baloda Bazar, Bhatapara (CG) for the offence punishable under Sections 304, 201, 202, 120B, 34 of the IPC.

As per the material available in the case diary, deceased Jugga Bai set herself on fire, sustained injuries and became unconscious, however, instead of taking her to the hospital for treatment, the accused persons placed her body in front of the photo of Guru Ghasidas Baba in the hope that miracle would happen and she would survive or would become alive. The dead body was kept in such position for about 4 days.

4. There is no allegation that the applicants were involved or were present at the time when deceased Jugga Bai set herself on

fire. It is the case of the applicants that the deceased was suffering from some kind of disease, therefore, being frustrated and disgusted, she committed suicide, in which, they have no role to play.

5. Considering the nature of allegations and for the fact that these applicants are in jail since 27.3.2021 and the charge sheet has already been filed, this Court is inclined to release the applicants on regular bail.

Accordingly, the applications are allowed and the applicants are directed to be released on bail on each of them furnishing a personal bond for a sum of Rs.50,000/- with one surety each in the like amount to the satisfaction of the trial Court. They are directed to appear before the trial Court on each and every date given by the said Court.
