This is the first bail application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant who has been arrested in connection with Crime No.425/2014 registered at Police Station- Civil Line, District Raipur (C.G.) for the offence punishable under Section 420 of I.P.C.

As per the prosecution case, the applicant has obtained Rs.1,10,000/- from one Alakhram Sahu to provide him government job and thereafter the fake appointment letter was given to him and on that basis the appointment could not be made; thereby the offence is committed.

Learned counsel for the applicant would submit that the applicant has been falsely implicated and the amount which was taken was as a loan and not with the understanding that the complainant will be provided job, therefore, the applicant may be released on bail.

Per contra, learned State counsel opposes the prayer for grant of bail and would submit that two other cases of similar like nature are registered against the applicant.

Perused the case diary, documents and the statement of the complainant. Having regard to the facts of the case and the way the offence has been committed and further considering the fact that another two cases of similar like nature are registered against the applicant, I am not inclined to release the applicant on bail. 6.

Accordingly, the bail application filed under Section 439 of Cr.P.C. is dismissed.
