1. Challenge through the present Criminal Revisioin is to the order dated 06/05/2016 passed by the Family Court, Raigarh in Misc.Criminal Case No. F-84/15, whereby the Court below has awarded an amount of Rs. 700/- as maintenance to the respondent.
2. Counsel for the applicant submits the said impugned order is bad on the ground that the respondent is not entitled to maintenance because she left the matrimonial house without any justified and satisfactory reason.
3. Perusal of the record would show that the applicant has not been able to produce any substantial evidence against the allegation made by the respondent before the Family Court in respect of the compelling circumstances in which she has left her matrimonial house. The evidence which has been lead by the wife who was the applicant before the family Court gives a clean indication as to why and what forced the wife to leave her matrimonial home. The evidence of the wife gets substantiated by the
evidence of PW-2 Kuldhar and PW-3 Siyaram.
4. In the above circumstance, there is no merit in the revision petition, the same is being devoid of merits is accordingly dismissed. Sd/- (P. Sam Koshy) Judge K
