This application under Section 438 of Cr.P.C. has been filed by the applicant apprehending his arrest in connection with Crime No. 102/2016 registered at Police Station Pandaria, Distt. Kabirdham (C.G.) for offence punishable under Sections 456, 354, 354 (1) A, 506 of I.P.C. 2.

As per the prosecution case, on 28/04/2016 at night the complainant was sleeping alongwith her mother-in-law and father-in-law, at that time the applicant came there and caught hold of the hand of the victim and tried to drag her, when she raised alarm her mother-in-law and father-in-law woke up, he was abused and was also pelted stones whereby son Meghnath got injury and the applicant fled away. 3.

Learned counsel for the applicant submits that story as has been stated is completely improbable and it is impossible that the applicant would come and behave in such a manner when inmates of the house are there. She submits that over a monetary dispute false allegations have been levelled, therefore the applicant may be granted benefit of anticipatory bail.

Learned State counsel opposes the prayer for grant of bail. 5.

Perused the statement of the victim under Section 161 and 164 of Cr.P.C. After perusal of the statement, I am not inclined to extend benefit of anticipatory bail to the applicant.

Accordingly, the anticipatory bail application is dismissed. Certified copy as per rules.
