1. Since all the petitions, except WPS No.4175 of 2015, involve common question of law and grounds, they are being considered and disposed of by this common order. For the sake of convenience, the pleadings and documents of WPS No.4113 of 2015 are being referred.
2. The petitioners would call in question the orders of termination issued by the Collector, Balrampur-Ramanujganj (CG) on the ground that before termination of their services, no enquiry was held nor any opportunity of hearing was afforded to any one of them.

Learned counsel for the petitioners would submit that the Collector (Tribal Development), Balrampur-Ramanujganj issued advertisement -Annexure P/2 on 11.4.2012 for filling up 268 posts of Peon amongst some other posts. The petitioners responded to the advertisement and submitted their applications. They appeared in the written examination and were placed in the merit list of 268 persons and were also permitted to appear in the counselling held on 4.6.2013 and subsequently, 190 more posts of Peon were sanctioned in the establishment of Tribal Development Department in the District, therefore, a second counselling was held on 24.6.2013.
At the end of selection process, a common appointment order of 355 Peons was issued on 02.07.2013. The petitioners joined the posts and were working without there being any complaint against any one of them. However, subsequently, some complaint was received in the ofÏce of Collector (Tribal Development) making allegations of irregularities, violation of reservation roster, etc. in the selection process. Therefore, the Collector got enquired the matter, wherein, it was found that 13 women candidates, 18 male candidates, one OBC candidate, one ST candidate, one SC candidate and 24 others have been appointed in contravention of the reservation roster applicable to Balrampur-Ramanujganj District.
4. Based on the findings of the enquiry committee, the Collector, Balrampur-Ramanujganj passed the impugned orders of termination. To buttress his submission, learned counsel would place reliance on the judgments passed by the Supreme Court in the matters of Om Prakash Mann Versus Director of Education (Basic) and others, 2006(7) Supreme 159 and Pavanendra Narayan Verma Versus Sanjay Gandhi P.G.I. of Medical Sciences and another, 2001 (8) Supreme 409.

Learned counsel for the State has vehemently argued that more than the advertised number of posts have been filled in and in doing so, the reservation roster of Balrampur-Ramanujganj District has not been adhered, therefore, there is inherent flaw in the selection process. He submits that since the appointment order is issued in excess of the advertised posts, there was no
requirement of adherence of principles of natural justice.

This Court is least impressed with the arguments advanced by learned counsel for the State for the simple reason that out of 355 persons appointed, the petitioners are only 57 in number meaning thereby that at present 298 Peons are still working which is more than the advertised number of posts i.e. 268.
7. The impugned orders itself mention the reason that the petitioners are terminated, because, excess number of candidates have been appointed than the number of posts in accordance with the reservation roster meaning thereby that the appointment is contrary to the reservation rules/roster.

Admittedly, the petitioners were neither noticed by the Enquiry Committee nor were issued any show cause notice by the Collector Balrampur-Ramanujganj before terminating their services vide the impugned orders, therefore, prima facie, there is violation of principles of natural justice and the impugned orders are hit by the principles enshrined under Article 14 of the Constitution of India.

It is true that in a case where allegations of mass irregularities or selection of huge number of ineligible candidates or corruption or discrimination or nepotism is alleged, in appropriate cases, the employer may not be required to adhere to the principle of natural justice as held by the Supreme Court in the matter of Union of India and others Vs. O. Chakradhar, (2002) 3 SCC 146.
10. However, the present is a case where there is no allegation of mass irregularity in the selection process. The fact that only 57 candidates have been shown the door, leaving 298 still working, which is more than the advertised number of posts, it was necessary for the respondents to issue show cause notice and afford opportunity of hearing to the petitioners.
11. It is not a case where giving opportunity of hearing to the petitioners would have been an empty formality. Since the order of termination only refers to adherence of the reservation roster without elaborately dealing as to in what manner the appointment of the individual petitioners was in excess to the reservation roster, it is not possible for this Court to scrutinize itself whether the petitioners are in a position to defend their appointment, after a show cause notice would have been issued.
12.In the facts and circumstances of the case, the impugned orders of termination deserve to be and are hereby quashed on the ground of violation of principles of natural justice. However, it will remain open for the respondents to initiate enquiry or give opportunity of hearing to the petitioners before terminating their services.
13.The writ petitions are allowed to the extent indicated above. WPS No.4175 of 2015 14.Learned counsel for the petitioner would submit that after completion of the selection process, the petitioner along with
other candidates was appointed on the post of AG-III vide Annexure P/3 and thereafter, the petitioner was rendering her service with sincerity and honesty. However, all of a sudden, the order impugned has been passed, terminating the services of the petitioner without affording opportunity of hearing to her. 15.According to learned counsel for the State, the petitioner and 10 other candidates were not selected against any advertisement, therefore, the impugned order is just and proper.
16.Similar question of law involved in this petition has already been dealt with in the preceding paragraphs i.e. in WPS No.4113 of 2015 and other connected petitions and the same have been allowed today by this common order.
17. In view of the above, the impugned order in this petition is quashed and this petition is also allowed in terms of the order passed in WPS No.4113 of 2015 and other connected petitions. Sd/- Judge (Prashant Kumar Mishra) Shyna/ Gowri
