----------------------------------------------------------------------------------------------- Hon'ble Shri Justice Pritinker Diwaker Order On Board 17/10/2016 Counsel for the petitioners fairly submit that there exists an alternative remedy for the petitioners to assail the order impugned before the Registrar and therefore, he may be permitted to withdraw this petition with liberty to avail the said remedy. He, however, submits that till filing of appeal before the Registrar, the interim order granted in favour of the petitioners may be maintained.
2. Counsel for the respondents have no objection so far as withdrawal of the present petition is concerned. They, however, submits that no interim order may be directed to continue in favour of the petitioners.
3. Considering the submissions made by the parties, the petitioners are permitted to withdraw this petition with liberty to file an appeal along with an application for interim relief before the Registrar within two weeks from today. On this being done, the appellate authority would be under an obligation to decide the interim application within two weeks from the date of its filing.
It is made clear that interim order granted by this Court in favour of the petitioners shall remain in force for a maximum period of four weeks from today, subject to decision of the appellate authority on the interim application. Sd/ (Pritinker Diwaker) Judge Khan
