NAFR HIGH COURT OF CHHATTISGARH, BILASPUR WA No. 23 of 2017 • Rajkumar Mishra S/o Late Ganesh Prasad Mishra, Aged About 46 Years R/o Haldibadi, Chirmiri, Thana-Chirmiri, Tah.-Khadgavan, District-Koriya (Chhattisgarh), E- Mail- rtichrm@gmail.com, M.O. No. 9406363699 ---- Appellant

Versus

• State of Chhattisgarh Through Chief Secretary, Mantralaya, Mahanadi Bhawan, Naya Raipur (Chhattisgarh) ---- Respondent Rajkumar Mishra, Appellant in Person.

For State / Respondent : Shri B. Gopa Kumar, Dy. Advocate General Hon'ble Thottathil B. Radhakrishnan, Chief Justice Hon'ble Shri Justice P. Sam Koshy Order on Board Per Thottathil B. Radhakrishnan, Chief Justice 27.03.2017 1.

We have heard the Appellant and the learned Deputy Advocate General for the State.

2.

The situation in hand is a chain reaction of non-compliance of the direction issued by this Court in WP(PIL) No. 35 of 2012. We say so because Contempt Case (C) No. 444 of 2013 filed by the Appellant on the basis of that judgment was closed on the basis of submission of respondent that they have already complied with the direction of this Court and provided facilities as per Section 4 of the Right to Information Act.

3.

Under the aforesaid circumstances, we are of the view that ends of justice would be served if the Appellant is left with liberty to seek

appropriate order reopening Contempt Case No. 444 of 2013, if he still has any grievance that the directions contained in the judgment dated 24.09.2012 passed in WP(PIL) No. 35 of 2012 have not been complied with.

4.

Without prejudice to what is aforesaid, this Writ Appeal is dismissed. Sd/- Sd/- (Thottathil B. Radhakrishnan) (P. Sam Koshy) Chief Justice Judge Chandra
