1. The applicant has preferred these two first bail applications under Section 439 of Cr.P.C. as he is in jail since 22.05.2021 in connection with same Crime No. 05/2021 registered in Police Station- Kohka Teregaon, District Rajnandgaon (CG) for the offence punishable under Section 34 (2) of the CG Excise Act.

2. Previously bail application i.e. 3750 of 2021 has been preferred by applicant through his counsel Shri S.S. Baghel whereas subsequently bail application i.e. 4504 of 2021 has been preferred by applicant through his another

M.Cr.C. No. 4504 of 2021 & M.Cr.C. No. 3750 of 2021 counsel Shri Jitendra Shukla.

3. Since two bail applications against the same crime number are not maintainable, Shri Jitendra Shukla, Advocate appearing for the applicant, seeks to withdraw bail application i.e. M.Cr.C. No. 4504 of 2021.

4. Accordingly, M.Cr.C. No. 4504 of 2021 is dismissed as withdrawn.
