(2) This is third bail application filed under Section 439 of the Cr.P.C. for grant of regular bail to the applicant, who has been arrested in connection with Crime No.274/2015, registered at Police Station Kotra Road, Raigarh, District Raigarh, for the offence punishable under Sections 420, 467, 468, 471, 12-B/34 of IPC and Section 66D of the I.T. Act.
(3) The applicant's first & second bail applications were dismissed on merit by orders of this Court dated 16.03.2016 & 03.08.2016 passed in M.Cr.C. No.1500/2016 & M.Cr.C. No.4786/2016, respectively.
(4) After hearing learned counsel appearing for the parties and taking into consideration the totality of facts and circumstances of the case, I do not consider it is a fit case to entertain the third bail application. Consequently, the third bail application is rejected. However, the trial Court is directed to explain and submit a report within three weeks as to why the order of this Court dated 03.08.2016 has not been complied with within a stipulated time in its letter and spirit.
