The applicant has preferred this application for grant of bail as he is arrested in connection with Crime No.157/2016 registered in Police Station Jhagrakhand District Korea (C.G.) for offence punishable under Sections 457, 380, 411 r/w 34 of Indian Penal Code. 2.
As per the prosecution case, a complaint was made by Yakub Khan that in the intervening night of 18-19 September, 2016 gold and silver ornaments have been stolen from the house. Subsequently, others Shiva, Sabbir and Lucky Sharma were arrested and on investigation it was found that some goods were sold to this applicant who was in habit of purchasing the same.

Learned counsel for the applicant submits that the applicant has been falsely implicated in the case, ornaments have not been identified
and only on presumption the applicant has been inculpated, therefore he may be released on bail.

Learned State counsel opposes the prayer for grant of bail and would submit that as many as 17 cases are to the credit of the applicant wherein certain cases are also registered under Section 379, 411 of IPC, therefore applicant was involved in the offence like that nature and he may not be released on bail.

Taking into fact that as many as 17 cases are to the credit of the applicant like that nature including offence under Section 379 and 411 of IPC, this Court is not inclined to release the applicant on bail. 6.
