1. The applicant has preferred this second bail application under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.131/2020 registered in Police Station Kharora, District - Raipur C.G. for the offence punishable under Sections 420, 406/34 of the I.P.C. and Sections 4 &6 of the Prize Chits and Money Circulation Schemes Act and Section 10 of the Chhattisgarh Nikshaepakon ke Hiton Ka Sarankshan Adhiniyam, 2005.
2. The applicant and co-accused persons obtained deposit of Rs. 48,05,980/- from different persons on assurance of doubling the amount within 15 days, but thereafter, even the
MCRC No. 4748 of 2021 original amount was not returned to them.
3. The first bail application of the present applicant was dismissed mentioning that bail application of co-accused Poshan Dewangan has been rejected in MCRC No.4834 of 2020 vide order dated 17.9.2020. The first bail application of Vikash Padamwar was also dismissed for the same reason. Now co-accused Vikas Padamwar has been released on bail in MCRC No.2806/2021 on the ground that Poshan Dewangan has been allowed bail in MCRC No.1835/2021.
4. Learned State counsel would oppose the prayer for grant of bail.
5. Considering the entire fact situation of the case as also considering the release of similarly placed co-accused persons, I am inclined to release the present applicant on bail.
6. Accordingly, the application is allowed and the applicant is directed to be released on bail on executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
