Learned counsel for the petitioner would submit that pursuant to the order of District Judge, Bilaspur dated 05-08-2014, the petitioner has made application to refund the amount of excess property tax of Rs.78,384/- on 13-03-2015 and also on 01-04-2015 to refund the amount of Rs.52,277/- have not been considered and decided.

Learned counsel for the respondent submit that the petitioner has not put his appearance pursuant to the order of the Distict Judge and the petitioner has not filed any such application dated 01-04-2015 for refund of the amount.

In order to resolve the dispute, it would be appropriate to direct the petitioner to appear before the Commissioner or before the competent

authority on 18th or 19th of this month with a suitable application for claiming relief/refund of the amount, which will be considered and decided by the said authority within a period of six weeks from the date of receipt of copy of this order.
