It is submitted by the counsel for the petitioner that name of the petitioner is Rana Sikandar, whereas the summons have been issued by the Court below in the name of Raja Sikandar. Secondly, it is also submitted that he is being prosecuted for a statement given by him soon after the accident, when he was in traumatic and disoriented stage and he had no intention to give any false information to the police officer.

Counsel for the respondent/State submits that document in complaint clearly mentioned that name of the petitioner is Rana

Page No.2 Sikandar. It is found that on the record of the Court below the name of the petitioner has been wrongly mentioned as Raja Sikandar i.e. the clerical mistake, which can be rectified. It is also submitted that second ground raised in this petition is a matter of evidence and enquiry, hence, the petitioner may be directed to appear before the trial Court and raise his defence.

Considering the submission made, it appears that this is not a fit case for admission. Hence this, petition is dismissed at the motion stage. Petitioner is directed to give his appearance before the Court below and make a prayer for cancellation of warrant issued against him.
