Hon'ble Shri Justice Rajendra Chandra Singh Samant Order On Board 22/07/2020 1.

This is the second bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant, who has been arrested in connection with Crime No.21/2018, registered at Police Station - Sarangarh, District - Raigarh (C.G.) for the offence punishable under Section 147, 148, 302, 323, 109 of the Indian Penal Code.

The earlier bail application of the applicant bearing M.Cr.C. No.6241 of 2018 was dismissed by the order dated 04.02.2019. The applicant then filed an application for grant of bail before the Supreme Court, which has been disposed off by order dated 23.04.2019 with a direction to the trial Court to ensure the early conclusion of the trial

preferably before March, 2020.

It is submitted by the counsel for the applicant that time limit granted by the Supreme Court has expired and the trial against the applicant is not completed, therefore, he may be granted bail. 4.

State counsel opposes the bail application and the submission made in this respect.

Considered on the submissions made. As the applicant has approached the Apex Court and his petition for grant of bail has been disposed off by order dated 23.04.2019 with specific direction, therefore, the judicial propriety calls that this Court shall not entertain and hear any application filed on behalf of the applicant and the same may be presented before the Apex Court itself, therefore, the application is disposed off.
