Hon'ble Shri Justice Sanjay K. Agrawal Order On Board 10/08/2020 (1) Proceedings of this matter have been taken up through video conferencing. (2) Dispute relates to release of the petitioner on parole under the C.G. Prisoner's Leave Rule, 1989.
(3) Case of the petitioner is that despite being applications filed, he has not been released on bail demanding local sureties.
(4) After hearing learned counsel appearing for the parties, I am of the opinion that the petitioner deserves to be granted liberty to move fresh application for grant of leave (parole) within a period of 10 days from today. (5) Accordingly, the petitioner is at liberty to file application for grant of leave (parole) before the District Magistrate, Bilaspur through Superintendent of Jail, Bilaspur within a period of 10 days from today. If such an application is filed by the petitioner, the District Magistrate, Bilaspur is directed to consider and decide the petitioner's application for grant of parole within a period of 10 days from its receipt.
(6) With the aforesaid observations & directions, the writ petition stands finally disposed of.
