This is the first bail application seeking for grant of bail to the Applicant who is in jail since 06.08.2017 in connection with Crime No. 142 of 2017 registered at Police Station Jashpur for the offence punishable under Sections 454 and 380/34 IPC. 2.

As per prosecution case, the applicant is said to have stolen ATM Card, Mobile Phone, NSC Bond papers and also cash from the house of Ashok Kumar Sinha after breaking the lock of the house. 3.

Learned Counsel for the applicant submits that it is a case where the applicant has remained in custody for more than 10 months and that the nature of offence is petty and therefore the present applicant be released on bail.

The State counsel opposing the application submits that it is a case where the applicant is a habitual offender and there are around 1718 criminal cases against the applicant and large number of them are that of theft cases.

Given the facts and circumstances of the case, particularly taking note of the past history of the applicant, this court is not inclined to release the applicant on bail. Accordingly, the bail application stands rejected.
