1. Heard.

2. The applicant has preferred the first bail application under Section 439 of the Cr.P.C., as he has been arrested in connection with Crime No.185/2021, registered at Police Station - Khursipar, District - Durg (C.G.) for the offence punishable under Section 392/34 of the Indian Penal Code.

3. The applicant alongwith three other co-accused persons, out of whom one is juvenile have committed loot of Mobile set valued at Rs.15,000/- from complainant Anil Soni.

4. Learned State counsel would oppose the prayer for grant of bail. He would submit that the concerned Station House Officer (S.H.O.) has not reported any previous criminal antecedents of the applicant.

5. Considering that the offences are triable by the Judicial Magistrate First Class (J.M.F.C.) and the applicant is in jail since 02-05-2021, I am inclined to release the applicant on bail

6. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
