1. This is an application filed u/s 439 of the Code of Criminal Procedure seeking granting of regular bail to the applicants in connection with Crime No. 175 of 2015 registered at Police station Fingeshwar, Distt. Gariyaband (C.G) for the offences punishable under sections 457, 380, 436, 201 of IPC and Section 4 of the Public Property Disposal Act, 1984.

2. As per the prosecution case, on 19.10.2015 when the class room of Govt. Higher Secondary School, Sender was opened, it was found that computer monitor, CPU, mouse, speaker, power cable etc., were stolen and the window was broken opened. Subsequently a report was made and CPU, monitor, mouse, speaker, printer etc., worth Rs.29,600/- were recovered from applicant No.1 Sanjeev Kumar; Rs.32,000/- was recovered from

Applicant No.2 Paremeshwar Bandhe and Rs.29,000/- was recovered from Applicant No.3 Suraj Kumar.

3. Learned counsel for the applicants submits that the applicants are students and they have been falsely implicated in this case. He further submits that the applicants are in jail since 21.10.2015 and prays for releasing them on bail.

4. Per contra, learned State Counsel opposes the prayer for grant of bail.

Taking into nature of offence and degree of allegations levelled against the applicants as also the fact that the charge sheet in this case has been filed and looking to the detention period of the applicants as they are stated to be in jail since 21.10.2015, I am inclined to release them on bail.

6. Accordingly, this bail petition is allowed and the applicants are directed to be released on bail on each of them furnishing a personal bond in sum of Rs.25,000/- with one surety each in the like sum to the satisfaction of the trial Court. They shall appear before the trial Court as and when directed by the said Court. Cc as per rules.
