Hon'ble Smt. Justice Rajani Dubey Order on Board 07/07/2021 Proceeding through video conferencing.

1. By this CRMP, the petitioner seeks modification of order dated 26.04.2019 passed in CRR No. 38/2010 with regard to extension of time to pay an additional fine of Rs. 10,000/-.

2. This Court vide order dated 26.04.2019 allowed CRR No. 38/2010 directing the aplicant to pay an additional fine of Rs. 10,000/- within six months from the date of order, failing which he shall have to undergo RI for two months. The fine amount so deposited by the applicant before the Trial Court be paid as Rs. 5000/- to the legal heirs of the deceased Tarebai and Rs. 5000/- to the legal heirs of the deceased Jai Singh, after due verification by the trial Court.

3. Learned counsel for the petitioner submits that though the petitioner was directed to pay an additional fine of Rs. 10,000/- within six months from the date of order, but the petitioner could not pay the additional fine due to the pandemic diseases Covid-19. Therefore, the petitioner may be granted further time for paying the additional fine as directed in the aforesaid order.

4. Having heard learned counsel for the petitioner and having considered the fact and situation of the case, the petitioner is granted further one month time to pay an additional fine amount.

5. Accordingly, the CRMP stands disposed of to the extent indicated herein above.
