Heard the matter on admission and also on maintainability. 2.

As per provisions contained in the Narcotic Drugs and Psychotropic Substances Act, 1985 (in short 'the Act, 1985), Section 60 onwards, the property in question, i.e., the said car allegedly used as conveyance and for commission of said crime shall be liable for confiscation. With this, the provisions of Section 60 onwards of the Act, 1985 is applicable. Looking to the said provisions, provision of Section 451 of the Code of Criminal Procedure, 1973 (in short 'the Code') is not attracted for the moment. 3.

With this, the instant criminal revision is disposed of without any appreciation on its merit reserving liberty to the applicant to pray before the trial Court for release of said vehicle on the basis of provisions of law mentioned in Section 60 onwards of the Act, 1985, as and when occasion arises. 4.
