2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.28/2020 registered at Police Station Taregaon Jungle, District Kabirdham (CG) for the offence punishable under Sections 366, 376 (2) (n) of the IPC and Sections 4, 6 of the Protection of Children from Sexual Offences Act, 2012.

3. The applicant has committed forcible sexual intercourse with the prosecutrix, who is less than 16 years of age.

4. Considering the material available in the case diary, no case for grant of bail is made out.

5. Accordingly, the bail application is dismissed. However, the applicant would be at liberty to repeat the prayer after examination of the prosecutrix.
