The present appeal arises from order dated 03.12.2015 in Writ Petition (S) 1210/2009 setting aside the Appellate Order dated 17.09.2008 passed by Respondent No. 2 remanding the matter to him for fresh disposal in accordance with law.

In view of the submission that the Appellant desires to pursue the

appellate remedy as directed by the learned Single Judge, reserving the right to raise all questions of facts and law before the Appellate Authority, the appeal is disposed in the aforesaid terms.
