1. Heard.

2. The applicant has preferred the first bail application under Section 439 of the Cr.P.C., as he has been arrested in connection with Crime No.243/2021, registered at Police Station - City Kotwali, Mungeli, District - Mungeli (C.G.) for the offence punishable under Section 420, 468 read with 34 of the Indian Penal Code.

3. As per the prosecution case, co-accused Sashi Lahre, Shailendra Lahre, Nitesh Lahre, Priyanka Lahre, Abhishek Rathore and Atul Rathore have received payment of different amounts from different victims by falsely assuring them of arranging employment in the

MCRC No. 4616 of 2021 government department. As against the present applicant, the allegation is of helping the main offenders. The seal of Forest Department which was used for issuance of forged appointment orders has also been recovered from the present applicant.

4. In two other crime numbers involving similar offence, the applicant and co-accused Nitesh Lahre, Priyanka Lahre and Abhishek Rathore have been released on bail in MCRC No. 3102 of 2021 and 3138 of 2021 & other connected matter.

5. Learned State counsel would oppose the prayer for grant of bail.

6. Considering that the present applicant is in jail since 17-06-2021 and in similar offence, he has already been released on bail, I am inclined to release the applicant on bail.

7. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one local surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
