1. The petitioner seems to be aggrieved of the inaction on the part of the respondents in not settling the retiral dues which the petitioner is entitled for in spite of having retired for more than 6 months ago.

2. According to the petitioner, he retired from the post of Principal, Government Higher Secondary School, Dongargarh w.e.f. 31.12.2020. Though more than 6 months have passed since the petitioner has retired, the petitioner has been paid only leave encashment and GPF

amount. The petitioner specifically states that the entire amount of gratuity, group insurance and pensionary benefits are yet to be finalized and he has not received any penny from the aforesaid heads.

3. Counsel for the petitioner on oath makes a statement that the petitioner is not facing any criminal case or any disciplinary proceeding nor is there any recovery proceeding outstanding against the petitioner with which the retiral dues could have been held back.

Given the aforesaid submission by the counsel for the petitioner, this Court is of the opinion that since it is only for settlement of retiral dues, let the respondents 2 & 3 take all necessary steps in ensuring that the entire retiral dues payable to the petitioner is scrutinized and settled in accordance with law and subject to due verification of facts so far as the entitlement of the petitioner is concerned, within a period of 60 days from the date of receipt of copy of this order.

It is made clear that unless there is anything under the rules with which the payment is held back, if the amount is not paid within the stipulated period of 60 days, the entire amount payable to the petitioner would carry interest @ 10% per annum and the interest part would be recoverable from the erring officers who do not promptly process the claim of the petitioner.
