1. The aforesaid MCrCs are being disposed of by this common order as they arise out of Crime No.517/2020 registered in Police Station City

MCRC 4529/2021 & MCRC 4700/2021 Kotwali, Raigarh, District Raigarh for offence under Section 420/34 of the IPC.

2. Although the matter is posted for orders on default, but considering that the default concerns wrong mentioning of the date of arrest, I proceed to hear the matter finally.

3. The present applicants along with co-accused Santosh Mahant have obtained payment of Rs.31,000/- from several victims assuring them of arranging employment as Cook in the Government Department.

4. Admittedly, co-accused Santosh Mahant has already been released on bail in MCRC No.8213/2020. The present applicants are in jail since July, 2020 i.e. for more than a year.

5. Considering that the co-accused has already been released on bail, the offence is triable by the Judicial Magistrate 1st Class and the applicants are in jail for the last more than a year, I am inclined to release them on bail.

6. Accordingly, the applications are allowed and the applicants are directed to be released on bail on each of them executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court.
