2. This is an application filed under Section 439 of the Code of Criminal Procedure for grant of regular bail to the applicant, who has been arrested in connection with Crime No.79/2021 registered at Police Station Pithora, District Mahasamund (CG) for the offence punishable under Section 306 of the IPC.

3. Deceased Khusbhoo Yadav, wife of the present applicant,

MCRC No. 4551 of 2021 committed suicide by self-ablaze on 22.1.2021. She was married with the applicant in February 2020. After the marriage, the applicant obtained loan of Rs.10,000/- from his in-laws for meeting expenses of agricultural operations, which he was not repaying to them. On the date of the incident, the deceased tried to persuade the applicant to return the amount to her father, on which, the applicant became enraged and assaulted her by hands and fists. After this incident, the deceased poured kerosene oil on herself and committed suicide by self-ablaze.

4. Considering the entire facts situation of the case and the fact that the applicant is in jail since 4.4.2021 and the charge sheet has already been filed, this Court is inclined to release the applicant on regular bail.

5. Accordingly, the application is allowed and the applicant is directed to be released on bail on his furnishing a personal bond for a sum of Rs.50,000/- with one surety in the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
