Proceeding Through Video Conferencing Hon'ble Shri Prashant Kumar Mishra, Ag CJ Order On Board /09/2021 :

1. The applicants have preferred this application for grant of bail as they are arrested in connection with Crime No.300/2021 registered in Police Station Basna, District Mahasamund, for offence under Section 20 (B) of the NDPS Act.

2. These two applicants were found in illicit possession of 6.400 kg of contraband Ganja during search on 3.6.2021. The illicit Ganja was being transported in an un-numbered motorcycle.

3. Learned State Counsel would oppose the prayer for grant of bail.

MCRC No. 4553 of 2021 However, he submits that the concerned SHO has not reported any previous antecedents of the applicants. He also submits that the applicants belong to the State of Odisha.

4. Considering the entire fact situation of the case and the fact that the charge sheet has already been filed, I am inclined to release the applicants on bail.

5. Accordingly, the application is allowed and the applicants are directed to be released on bail on each of them executing a personal bond for a sum of Rs.1 lakh with one local surety for the like amount to the satisfaction of the trial Court.
