1. Heard.

2. The applicant has preferred the first bail application under Section 439 of the Cr.P.C., as he has been arrested in connection with Crime No.76/2021, registered at Police Station - Police Chowki Wadrafnagar, P.S. Basantpur, District - Balrampur-Ramanujganj (C.G.) for the offence punishable under Sections 457, 365, 366, 506, 323 of the Indian Penal Code.

3. The applicant was in love with victim, a girl, aged about 18 years. As her parents were not willing to marry the girl with the applicant, he committed house trespass at about 10 p.m. on 08-05-2021 and

MCRC No. 4556 of 2021 informed the inmates that he will marry the victim. He slapped the mother of the victim and thereafter both of them moved on motor cycle and reached applicant's house, wherefrom she was recovered on the next day. As per her statement, applicant has not sexually molested or exploited her.

4. Learned State counsel would oppose the prayer for grant of bail.

5. Considering the entire facts situation of the case and for the fact that the applicant is in jail since 09-05-2021 i.e. for more than three months and also the charge sheet has already been filed, I am inclined to release the applicant on bail.

6. Accordingly, the bail application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of Rs.50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
