Learned Government Advocate appearing for respondent No.1/State would submit that order impugned is appealable before the Collector, Surguja.

In view of that, learned counsel appearing for the petitioner would submit that the petitioner may be permitted to prefer an appeal before the Collector, Surguja. 4.

The petitioner is permitted to do so. If the petitioner

prefers an appeal before the Collector, Surguja within a period of 30 days from today, the Collector, Surguja would do well and decide the appeal within a period of three months from the date of filing of the appeal along with copy of this order on merits.

With the aforesaid observation, the writ petition stands finally disposed of. No order as to cost(s).
