This is the first bail application filed under Section 439 of the Code of Criminal Procedure, 1973 for grant of regular bail to the applicant who has been arrested in connection with Crime No. 15/2015, registered at Police Station R.P.F. Bhatapara, Raipur, District Baloda Bazar Bhatapara (C.G.), for the offence punishable under

Section 3(A) of R.P.U.P. Act.

Case of the prosecution, in brief, is that, applicant was found in possession of the Railway property namely 400 Steel Liners amounting to Rs. 7,000/- and thereby committed aforesaid offence.

After hearing learned counsel appearing for the parties and taking into consideration the fact that property has been recovered from the possession of the applicant is said to be Railway and is not available in the Market, I am not inclined to release the applicant on regular bail. 4.

Accordingly, bail application filed under Section 439 of the Cr.P.C. is rejected.
