1. This application under Section 438 Cr.P.C. has been preferred by the applicant apprehending his arrest in connection with Crime No. 16 /1995 registered in Police Station -Bishrampur, District- Surajpur (CG), for alleged commission of offence under Sections 465, 471, 420 IPC.
2. Learned counsel for the applicant, at this stage, seeks to withdraw this application by submitting that the applicant is willing to surrender and apply for grant of regular bail before the Court below. He would submit that in view of peculiar circumstances of the case that number of coaccused have already been acquitted, the Court below may be directed to decide the application for grant of regular bail on the same day.
3. Considering the submission made, the application is dismissed as withdrawn with the liberty as prayed for.
-24. In case the applicant surrenders and moves application for grant of regular bail before the Court below, the same shall be considered and decided at the earliest preferably within three days.
