1. At the outset, learned counsel appearing for the petitioner submits that he does not want to press this petition as he intends to file a fresh civil suit. He also prays that pendency of instant civil suit should not come in the way of filing of fresh civil suit.

2. In view of aforesaid submission, the petition is dismissed as withdrawn.

3. Needless to mention that this court has not expressed any opinion on the merits of the fresh civil suit which the petitioner intends to file. The said suit, if filed, would be dealt with purely in accordance with law prevailing the field. Sd/- (P.Sam Koshy) Judge inder
