Order On Board 28/11/2017
1. By order Annexure P-1 petitioner was directed to work as Cluster Academic Coordinator at Ramgarh and he started carrying out the duties of the said post. However, by order Annexure P-3 Block Education Officer Bharatpur, District Korea has cancelled the said arrangement on the basis of some oral instruction issued by the District Mission Coordinator, Rajiv Gandhi Shiksha Mission, Baikunthpur.
2. Learned counsel for the respondent Nos. 2 & 3 would submit that the previous Cluster Academic Coordinator posted at Ramgarh proceeded on medical leave, therefore, the petitioner was directed to work temporarily and the order Annexure P-1 was not an order of appointment.
3. Considering the issue brought before this court and for the reason that the impugned order Annexure P-3 refers to some oral instruction issued by the District Mission Coordinator, Rajiv Gandhi Shiksha Mission, Baikunthpur, it would be appropriate that the said authority considers the issue on a representation filed by the petitioner.
4. Accordingly, the writ petition is disposed of with a direction that in the event, petitioner prefers a representation before the respondent No.3 against the impugned order Annexure P-3 dated 07.01.2017 passed by the Block Education Officer Bharatpur, District Korea within a period of 4 weeks from today, the said authority shall consider and decide the representation by speaking order at the earliest preferably within the next 2 months.
5. Till the representation is decided or for a period of three months from today, whichever is earlier the interim order passed earlier by this Court shall continue to operate in petitioner's favour.
6. Accordingly, the writ petition is disposed of with the aforesaid liberty.
