2. The challenge in the present writ petition is to the order of suspension of the petitioner dated 02.07.2020 (Annexure P/1) issued by the respondent No. 2 against which an appeal has already been preferred vide Annexure P/6.
3. Learned counsel for the petitioner submits that since the office of the appellate authority is not functioning, therefore, the instant writ petition has been filed and the order of suspension is per se illegal.
4. Considering the fact that the appeal has already been filed and the appeal is pending before the appellate authority and the appeal is permissible under Rule 23(III) of CCA Rules, 1966. In view of the fact since the appeal is already pending, it is expected that the appellate authority shall decide the appeal as early as possible on its own merits.
5. With the aforesaid direction, the present writ petition stands disposed off.
