(1) The accused/applicant has moved this bail application under Section 439 of the Code of Criminal Procedure for releasing him on regular bail during trial in connection with Crime No.260/2015 registered at Police Station Katghora, District Korba for the offences punishable under Sections 392 & 394 of the Indian Penal Code.
(2) Case of the prosecution, in brief, is that applicant poured chilly power in the eyes of complainant - Dev Narayan and robbed his motor cycle worth Rs. 30,000/- and thereby committed the aforesaid offences. (3) After hearing learned counsel appearing for the parties, taking into consideration the facts & circumstances of the case; role of the present applicant in the offence in question and the manner in which
